    Re: Judge Kevin K. Ryan with his criminal offense against Human Dignity and Rights with a short same morning notice trial (Notice was an unreceived telephone call to me while I was in cardiac intensive care)

Dear Ms. Garcia:

    It’s intolerable to the people and to me.  Your time to act is now.  You swore to uphold  the NY Constitution and article § 6. .... The power of grand juries to inquire into the wilful misconduct in office of public officers, and to find indictments or to direct the filing of informations in connection with such inquiries, shall never be suspended or impaired by law. No person shall be deprived of life, liberty or property without due process of law.

    Your defining moment is arrived.   Do you serve the people or the corrupt?

    My wife has admitted that I was a candidate for a heart transplant.   I was defribrillated five times in 2008.   I’ve been disabled with both hands with painful nerve condition and difficulty with balance in walking since 1992, with both rotator cuffs dysfunctional, a stroke and a cancer operation   I’m a Senior citizen on Social Security for three years.  Judge Ryan wants to take all my retirement savings to enrich his lawyer buddy, Ara Asadourian.

    Judge Ryan moved up a two week later scheduled court action to later in the same day’s morning while I was in intensive cardiac care and the notice to me was a call by the  judge’s staff to the hospital.  FACT: The doctor /hospital does not accept calls to a patient in cardiac intensive care.    And why, after receiving the hospital reports, did Judge Ryan did not rehear the matter while I could be present?

    Do you think calling the hospital to move up a trial to later that same morning excuses that resulting ex parte trial?    You are compelled by law and human decency to stop this criminal and unethical Judge.

    With an action still pending against him in Federal 2nd Circuit Court of Appeals, I received an order he signed at the end of June 2009 taking away my home and retirement savings.    I demand my rights as a citizen.   Uphold your oath.   Your timely and immediate action is required.

     I and the people of Essex County demand that you convene a Grand Jury to indict and prosecute Judge Kevin K. Ryan, Ara Asadourian and Marsha Kameron.   Begin with Penal law  §195.00 Official misconduct.  A public servant is guilty of official misconduct when, with intent to obtain a benefit or deprive another person of a benefit:  1. He commits an act relating to his office but constituting an unauthorized exercise of his official functions, knowing that such act is unauthorized; or
    2. He knowingly refrains from performing a duty which is imposed upon him by law or is clearly inherent in the nature of his office.

    Attached is a sworn criminal complaint against Judge Kevin K. Ryan.  Use this complaint to convene a grand jury.   There is no judicial immunity by the NY Constitution “The power of grand juries to inquire into the wilful misconduct in office of public officers ... shall never be suspended or impaired by law.”

    The last attached affidavit has sufficient information to charge Ara Asadourian and Marsha in regard to perjury .    Also, immediately comply with my freedom of information requests.

refusing to use precedent of higher courts,  ex parte communications; making pre trial motions’ decisions which were not appealable; knowingly accepting perjury; taking some rights from a pro se allowed to attorneys; ruling Pro Se cannot impeach a witness's testimony with deposition testimony, nor impeach the testimony of a witness with the witness's affidavits or court documents in the same action, nor ask about  sworn items in the complaint, nor cross examine certain witnesses; refusing to allow any subpoenas for pro se; reversing the order of closing arguments with pro se defendant going first in the closing argument; allowing Asadourian to claim this is the worst case of abuse he has seen in 20+ years, and allowing Asadourian to yell at witnesses and me.
