Re: Judge Kevin K. Ryan with his new offense against Human Dignity and Rights with a short same morning notice trial (Notice was an unreceived telephone call to me while I was in cardiac intensive care)

Dear Mr. Tembeckjian and CJC members:

Please use this opportunity for you based on additional information to preserve your honor and faithfulness to your oaths and law. Judge Kevin K. Ryan continues this month his criminal* unethical conduct. I make you aware of my disability and demand that Mr Tembeckjian and each of the CJC members not allow this Corrupt Judge Ryan to abuse me because of the limitations resulting from my disability.

My wife has admitted that I was a candidate for a heart transplant. I was defribrillated five times in 2008. I’ve been disabled with both hands with painful nerve condition and difficulty with balance in walking since 1992, with both rotator cuffs dysfunctional, a stroke and a cancer operation I’m a Senior citizen on Social Security for three years. Judge Ryan wants to take all my retirement savings to enrich his lawyer buddy, Ara Asadourian.

Judge Ryan moved up a two week later scheduled court action to later in the same day’s morning while I was in intensive cardiac care and the notice to me was a call by the judge’s staff to the hospital. FACT: The doctor /hospital does not accept calls to a patient in cardiac intensive care. And why, after receiving the hospital reports, did Judge Ryan did not rehear the matter while I could be present?

Do you or any Commission members think calling the hospital to move up a trial to later that same morning excuses that resulting ex parte trial? Mr. Tembeckjian, you and each of the members of CJC are compelled by law and human decency to stop this criminal* and unethical Judge.

With an action still pending against him in Federal 2^nd Circuit Court of Appeals, I received, two days ago, an order he signed at the end of June 2009 taking away my home and retirement savings.

Your duty is to remove a judge who wantonly violates judicial cannons, human rights, and dignity and not to excuse his miscreanism because an appellate court might overrule him. Will you deprive me and others of limited means from receiving justice and allow a judge to continue to harm others without a huge reserve of money? I demand my rights as a disabled person and citizen. Uphold your oaths. Your timely and immediate action is required.

For your immediate purview, I’ve attached condensed letters to Administrative Judge Caruso concerning Judge Ryan’s earlier misconduct and your office has copies of the latter medical records concerning the trial rescheduled on the same day I was in cardiac intensive care.

Will you sacrifice your honor and your duties to protect Judge Ryan?

NY Law § 195.00 Official misconduct. A public servant is guilty of official misconduct when, with intent to obtain a benefit or deprive another person of a benefit:

1. He commits an act relating to his office but constituting an unauthorized exercise of his official functions, knowing that such act is unauthorized; or

2. He knowingly refrains from performing a duty which is imposed upon him by law or is clearly inherent in the nature of his office.

I heard your testimony on June 8, 2009. Your commission obviously erred in dismissing my complaint. I’m resubmitting it and including other misconduct by Judge Kevin K. Ryan which occurred after the original complaint was filed. Judge Ryan knowingly allowed perjury and fraud by a former DA, Ara Asadourian, who told a jury I was the worst Domestic Violence Abuser in the North Country since 1972 and the Police intervened to stop me. Judge Ryan refused to allow Police records to show no DV intervention ever occurred. Judge Ryan told the jury to disregard that testimony.

I have been defribrillated five times and Judge Ryan moved up a trial date to when he knew I was in cardiac intensive care. Judge Ryan dismissed an action for damages from an assault and battery and attempt to cause my death,. allowing Ara Asadourian to claim in one action that the assault, battery, an attempt was only an accident and then claim it was deliberate.

Judge Ryan’s reversed the order of closing arguments. This is only a very shortened list of my complaints against Judge Ryan.

Is this CJC acceptable judicial conduct? The people would hope not. There is no need to review my complaint against Judge Dawson, since the voters have discarded him.
